Description
The state government placed a circular before the High Court, which asks apartment owners and residents’ welfare associations not to engage child labour and also lists out a set of guidelines for protection of women and children against trafficking. Taking note of it, the High Court disposed of a petition seeking directions to protect children and women from trafficking.In the circular, the Labour Commissioner has asked the jurisdictional officers to check all apartments, housing complexes and residential properties to ascertain if any children are employed and has asked them to take effective steps for spreading awareness against child labour. The commissioner also directed the officers to check on job placement agencies, functioning in their jurisdiction and report as to whether those agencies are duly following the laws. Appreciating the government for proactive and responsive approach, Justice Ashok B Hinchigeri disposed of the petition filed by a woman from Jharkhand, a victim of alleged human trafficking. Highlights of the Guidelines: Encompassing the women and child development, health, education and labour departments, suggestions have been made for channelising schemes on women empowerment, protection of children, poverty alleviation and skill development, inclusion of a chapter on trafficking in school syllabus. The guidelines also suggest protection of victims by keeping them away from the accused, identifying traffickers/pimps and booking them under Goonda Act, fast-tracking of human trafficking cases to reduce trauma and suffering of the child, etc. On rehabilitation, the guidelines say that with regard to victims who have been trafficked out of Karnataka, Department of Women and Child Development should communicate with the states from which the children have been rescued. It also speaks of two-pronged strategy of educational and economic rehabilitation of victims of trafficking. It also specifies standard operational procedures/protocols for rehabilitation, reintegration and repatriation of trafficked victims specifying the roles and responsibilities of the respective states/departments with timelines. Ensuring proper 24x7 security at shelter homes, keeping away sharp objects, hazardous and inflammable material from shelter homes to ensure that victims do not attempt suicide and also ensuring strict policy on access to visitors. Regarding foreign nationals, the guidelines stipulate setting up of a temporary shelter till their case is processed for repatriation.
